Acceptance of Terms
Silent Edge Entertainment LLC d/b/a Nightmare Factory Haunted Attraction (the “Company”) provides its website, ticketing services, and live attraction (collectively, the “Service”) subject to the following Terms of Use (“Terms”). By accessing our website, purchasing tickets, or attending the Nightmare Factory Haunted Attraction (the “Event”), you agree to be bound by these Terms.
Binding on All Attendees: The individual purchasing tickets (“Purchaser”) agrees to these Terms on behalf of themselves and all other attendees for whom they purchase tickets (collectively, “Participants”). By using a ticket to enter the Event, each Participant is deemed to have accepted and agreed to these Terms and the Liability Waiver, regardless of whether they personally purchased the ticket.
If you do not agree with these Terms, do not use our website, do not purchase tickets, and do not attend the Event.
Eligibility and Age Restrictions
- Tickets must be purchased by individuals 18 years or older.
- Guests aged 13 to 17 may attend only with the consent of a parent or guardian.
- Children under 13 are not recommended and should not attend.
Ticket Purchases and Refund Policy
- ENTER AT YOUR OWN RISK. ALL SALES FINAL.
- No refunds for cancellations without Ticket Protection.
- We remain open during rain; please dress appropriately as lines and portions of the Event are outdoors.
- No refunds for fear, weather, early exit, lost or stolen tickets, or unused tickets.
Assumption of Risk and Release of Liability
By entering the Nightmare Factory Haunted Attraction, you voluntarily assume all risks and hazards associated with the Event.
This attraction includes intense scares, sudden loud noises, strobe lights, fog, darkness, uneven surfaces, and close interactions with actors, including incidental and intentional physical contact. Such contact may include brushing, guiding, light restraint, or other controlled actions.
Health Warnings: Do not enter if you have heart conditions, epilepsy or sensitivity to flashing lights, asthma or respiratory issues, back or neck conditions, pregnancy, mobility limitations that pose safety issues, or any condition that could be aggravated by scares or physical contact. By attending, you represent that you are medically and physically fit.
Medical Acknowledgment: Participants acknowledge risks including but not limited to dizziness, fainting, nausea, allergic reactions, muscle cramps, joint pain, sprains, strains, musculoskeletal injury, heart attack, stroke, or sudden death. If symptoms occur, Participants must discontinue participation immediately and seek medical attention.
First Aid Disclaimer: Participants release the Company and related parties from any claim arising from any first aid, treatment, or service rendered in connection with participation in the Event.
Infectious Diseases: Participation includes possible exposure to infectious diseases (including but not limited to COVID-19, influenza, RSV, or other airborne or surface-transmitted illnesses). By entering, Participants knowingly and voluntarily assume all risks of exposure, whether arising from the negligence of the Released Parties or otherwise.
Release: To the fullest extent permitted by law, you release and hold harmless the Company and all related parties from any liability for injuries, losses, or damages of any kind. Related parties include owners, employees, volunteers, performers, contractors, vendors, landlords or lessors of premises or equipment, and affiliated entities. This release applies to the Purchaser and all Participants admitted under the Purchaser’s order, including minors. This release does not extend to gross negligence or willful misconduct.
Participant Conduct and Safety Rules
Guests must follow all rules and staff instructions. The Company may refuse admission or remove guests without refund for unsafe, disruptive, or inappropriate behavior.
- Actor Interaction: Performers may touch guests as part of the designed experience. By entering, you consent to this interaction.
- Guest Conduct: Guests may not touch performers or other guests in an aggressive, retaliatory, or unsafe manner. Violations may result in removal without refund and possible referral to law enforcement.
- No Weapons or Dangerous Items: Weapons (real or fake), knives, firearms, fireworks, and hazardous objects are prohibited.
- No Drugs or Alcohol: Entry will be denied to intoxicated guests. Illegal substances are not permitted.
- No Unsafe Behavior: Running, pushing, striking, climbing, or entering restricted/staff areas is prohibited.
- Emergency Exits: Guests may exit early but will not receive refunds.
- Supervision: Parents/guardians are responsible for minors under their care.
Additional Disclaimers
- Personal Property: The Company is not responsible for lost, stolen, or damaged belongings.
- Photo/Video Consent: By entering, you consent to the use of your likeness in photography, video, or other media for promotional purposes without compensation.
- Food/Allergens: Food and beverages may contain allergens. Guests with allergies must exercise caution.
- Animals: Only ADA-recognized service animals are permitted. Pets, emotional support, or other animals are not allowed.
- Parking: Vehicles are parked at the owner’s risk. The Company is not responsible for theft, loss, or damage in parking areas, whether or not under Company control.
Online Services and Third-Party Platforms
- Tickets may be processed by third-party platforms such as FareHarbor. Their terms and privacy policies apply.
- The Company is not responsible for errors, downtime, or security issues of third-party services.
Intellectual Property
All names, logos, designs, images, audio, video, and materials are the property of the Company or used with permission. Unauthorized reproduction or distribution is prohibited.
Disclaimer of Warranties
The Event and website are provided “as is” and “as available” without warranties of any kind, express or implied. The Company does not guarantee uninterrupted service, error-free content, or safety beyond what is reasonably expected for a haunted attraction.
Limitation of Liability
To the fullest extent permitted by law:
- The Company and related parties will not be liable for indirect, incidental, special, or consequential damages.
- If liability is established, damages will not exceed the ticket price paid.
SMS Messaging Terms
By providing your mobile number to the Company, you consent to receive SMS or MMS text messages from us, including but not limited to event updates, ticket confirmations, reminders, weather alerts, and promotional messages related to the Nightmare Factory Haunted Attraction. Message frequency may vary, and standard message and data rates may apply according to your mobile carrier plan.
You may opt out of receiving text messages at any time by replying STOP to any message. After you send STOP, you will receive one additional message confirming that you have been unsubscribed. To rejoin, you may reply START or re-subscribe through our website or ticketing service.

We will never sell, rent, or share your mobile number with unaffiliated third parties for their own marketing purposes. Text messaging is provided through third-party platforms compliant with U.S. carrier and industry regulations, including The Campaign Registry (TCR).
Indemnification
You agree to indemnify, defend, and hold harmless the Company and related parties from claims, damages, or expenses (including attorneys’ fees) arising from your attendance, actions, or violation of these Terms.
Dispute Resolution and Arbitration
Any dispute, claim, or controversy arising from these Terms, the website, tickets, or Event shall be resolved by binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules.
- Arbitration will occur in North Carolina, in or near Craven County.
- Claims must be brought individually, not as part of a class or group action.
- Each party shall bear its own legal fees, with arbitrator fees split unless otherwise required by law.
- Judgment on the arbitrator’s award may be entered in any court of competent jurisdiction.
Exceptions: Either party may bring eligible claims in small claims court or seek injunctive relief in court for intellectual property or safety concerns.
Governing Law: These Terms are governed by North Carolina law and the Federal Arbitration Act.
Changes to Terms
The Company may update these Terms at any time. Updates will be posted with a new “Last Updated” date. Continued use of the website or attendance at the Event constitutes acceptance of the revised Terms.
